'Don't Ask, Don't Tell' Temporarily Upheld By Appeals Court

Wednesday, October 20, 2010

And Obama's DoJ's briefs defending DOMA in the court challenge of DOMA advancing legal arguments that, if pursued by the courts, could greatly damage gay and lesbian rights (that homosexuality is the equivalent of incest and pedophilia/child rape) doesn't set bad precedent?

And Obama's not replacing Bush-era US attorneys when he got into office (as has every other president) so that they can continue to prosecute Bush-style obscenity prosecutions isn't setting bad precedent?:

Federal judges determine policy all the time. Federal judges overturn laws all the time, and very very very few cases ever make it to the US Supreme Court for final dispensation.

It's a shame there isn't a way to fire a supreme court justice.

A Supreme Court Justice may be impeached by the House of Representatives and removed from office if convicted in a Senate trial, but only for the same types of offenses that would trigger impeachment proceedings for any other government official under Articles I and II of the Constitution.

'Don't Ask, Don't Tell' Temporarily Upheld By Appeals Court

Obama doesn't have to issue a signing statement -- All that he has to do is NOTHING. No appeal. DADT would end.

From RachelMaddow's program last week:

== AaronBelkin, an expert on the issue at UC SantaBarbara told the NewYorkTimes that, “Unless the president declines to appeal the ruling in LogCabinRepublicans versus the United States, the ‘Don‘t Ask, Don‘t Tell‘ policy probably will remain law for years.”

Unless you believe the US Senate is going to do the right thing by g@y people. This year, with JohnMcCain still there & a slate of homoph0b!c Republican Senate candidates poised to enter. Unless you believe that the US Senate after this year‘s elections is going to do the right thing by g@y service members, then the decision by the ObamaAdministration, whether or not to appeal this ruling, is likely a decision between k!lling this policy now & letting it survive probably forever.

Obama's DoJ appealing this ruling was not an inevitability. The administration is not obligated to appeal. If the administration believes the law is unconstitutional, there's precedent that supports the administration not appealing it & letting the law d!e.

An orderly time frame for the de@th of a law can be arranged with the court. That's the way it is. A plan that has no chance of becoming reality is not a real plan no matter how much you say it is. You can either end it or you can stop saying you will.==

No, apparently people who have no mortgages, who own their homes outright, have been evicted, their homes foreclosed and sold out from under them, too.

Then there's HAMP. People who are trying to pay their mortgages, trying to work with the banks, but it's only voluntary on the bank's part.

All Obama has to do is not appeal.

That's it.

That ends DADT.

But Obama is counting on a US Senate voting to overturn DADT before a new Congress is sworn in next year (with John McCain vowing to filibuster it).

Is Vicky Hartzler the Most Anti-Gay Candidate in America?

When your words don't match your actions, stories like this one shouldn't get dismissed out of hand:

The interview was with Washington Post's Jonathan Capeheart. Valerie Jarrett, senior aide to Obama, said about Minnesota g@y teen Justin Aarberg, who committed su!cide in July after being bull!ed, that he made a "lifestyle choice."

It's at around 4:15 on the video -

http://mpetrelis.blogspot.com/2010/10/whs-jarrett-dead-gay-bully-victim-made.html

"Being gay", according to one of Obama's closest top aides (reportedly his closest aide) is a "lifestyle choice".

Jarrett says that she "misspoke".

Listen to the tape; get the entire context.

Try saying "homosexuality a lifestyle choice" and explain how you "misspoke".

Accuracy & precision in language about one of your core base constituencies is basic, fundamental in politics. It's 99% of politics, and how politicians finesse others.

It's an outrage for Jarrett to even try to dismiss her comment in that way, as "misspeaking". She's one of the top representatives for Obama; she speaks for him. Every word out of her mouth is the policy of the president; she broadcasts to the world the real policies of the administration she works for.

Can you imagine her not being fired had she said something equally as offensively ig.no.rant about women or J#ws or blacks? How can she be effective in advancement for gays when she holds the same beliefs about gays as do fundamentalist rightwingers?

Jarrett needs to resign or be fired.

Nancy Pelosi May Not Run Again For Speaker: Democratic Congressman

What do you think Obama is going to do after the November 2 elections if Republicans take control of one or both Houses of Congress?

Do you think he'll veto the legislation they pass (through reconciliation & every other means they can manage)? Do you think Obama will take to the bully pulpit, urge Americans to bury Republicans in email, phone calls, snail mail, & urge Democrats to block Republicans every way possible?

Or do you think that Obama's going to be making deal after deal with them, spinning what he can as somehow "Good for the People and Democrats", and/or, "I'm president of all the People, & the People in their infinite wisdom put Republicans in the majority, so I must honor their wishes & work with Republicans, & not try to obstruct their will"?

And if Democrats keep control of Congress? Do you think Obama's going to continue trying to work in a "bipartisan manner" with Republicans, keep flip-flopping on his campaign promises, & say that the election was a referendum on his trying "change the tone in Washington", and voters want him to do more of the same?

If you think Obama has seen the light, guess again:

Obama's already broadcast what he & Democrats are going to do if Democrats remain in the majority:

==According to excerpts from the Times, aides say that the president's been spending "a lot of time talking about Obama 2.0," brainstorming with administration officials about the best way to revamp the strategies & goals of the WhiteHouse.

And despite the predictions that Democrats may relinquish a large degree of legislating power, including perhaps control of the House & even Senate, Obama isn't thinking of the next two years as a period that'll be marked with the same obstructive nature from the GOP.

"It may be that regardless of what happens after this election, [Republicans] feel more responsible, either because they didn't do as well as they anticipated, & so the strategy of just saying no to everything & sitting on the sidelines & throwing bombs didn't work for them," Obama says in the article. "Or they did reasonably well, in which case the American people are going to be looking to them to offer serious proposals & work with me in a serious way."

You are not limited to voting for just Democrats and Republicans. There are other alternatives besides sitting out the election or voting for Republicans. There are other candidates running as independents, from Green to Libertarian, in just about every race.

Anyone who tells you to be quiet, not criticize Obama and Democrats, that you must vote for Democrats because they're "the lesser of 2 ev!ls", tell them to STFU because they're trying to deny your holding your elected representatives' feet to the fire, to live up to their campaign promises.

Right now, this very period, the weeks leading up to an election (voting's already begun and it may be too late) -- That's it for making our deals with the candidates. Our elections every two years is a window period, a time to re-up or opt-in/opt-out. Vote incumbents out who have failed to achieve on their campaign pledges. For whatever reason, they are not capable of achieving what they claim to be their own and their constituents' shared objectives. Vote against them now or forever (in another 2 years) hold your peace.

The McLaughlin Group: It's the "Professional Left's" Fault

No matter what the outcome of this election, Obama will spin it as a mandate for continuing a pro-corporate, anti-populist agenda. The TeaParty is an effective nemesis for him, but in fact, they're toothless.

There are only 600 registered nationally, & what they actually are is the Republican base. There are only a handful of them even running, & even if they all won (O'Donnell's 20 points behind in the polls), they'd move to the left as Scott Brown has done ("Sarah Palin, who?") or remain fringe. But in any case they'd be controlled by Republican leadership in the Congress. They're really not a "growing movement" any more than Republicanism is growing -- They're the Republican Party. They're not any more conservative than the party's been for 30 years.

But my problem is with a Democratic Party that is utilizing the same fear tactics that Bush-Cheney utilized before elections. Only now it's fear of teabaggers scaling the walls of our democracy with knives between their teeth to behead us, instead of Al Qaeda.

Once the election is over, what Obama & the DLC-Democrats are going to do after November 2nd are things we'd be discussing (and objecting to) now, pre-election, if we had the chance.

And winky smile back atcha. ;-)

We saw how this played out through the 2009 summer debate over healthcare reform. Obama disappeared from the public debate, which was especially onerous during the town halls when teabaggers came into prominence & disrupted any real discussion. Obama cut secret deals with Big Insurance, PhRma, hospitals, the AMA, etc., & lied about it.

Elevating the TeaParty to prominence, enabled Obama's watered down legislation, making it Republican-like & thus he could deliver to the corporations, move the DemocraticParty even farther to the right in order to attract moderate Republican politicians & their supporters into the Democratic Party.

Expect more of that after November 2nd, when Obama will put more NAFTA-like free trade deals through.

But we can't discuss that and other issues important in this election now, because it's all about witchcraft and Ginny Thomas.

Obama came into the WhiteHouse with Republicans not even on the ropes, but on the mat & unable to breath, after the 2008 election, but Obama & Emanuel gave them life support & let them rise again.

After just one month in the White House, instead of going after Republicans & finishing them off, instead of hammering BushCheneyGOP for our economic woes & wars of choice, Obama & RahmEmanuel went gunning for SarahPalin & RushLimbaugh, two people with no role in the RepublicanParty.

Obama & Emanuel have never mentioned MitchMcConnell, JohnBoehner, EricCanter, KarlR0ve, GeorgeW, H.W., JebBush, Cheney, NOBODY who is actually IN the RepublicanParty as the problem.

The Tea Party serves them in several ways. If they could choose any Republican to run against in 2012, it would be Palin, and elevating the Tea Party makes that more of a possibility.

It also lets Democrats keep a legislative agenda to the right of center. If the teabaggers are far rightwing, then everything to their left is ground the Democrats can claim (and that's a lot of ground).

I appreciate your problem with this, I really do. But, here's my problem with this:

Words have meanings. I wish 'they' (whoever 'they' are who coin these terms) had picked another word to meet the definition, because there's nothing 'liberal' about 'neoliberalism', but 'they' didn't.

My problem with using 'right-wing conservatism' to describe Obama is that it doesn't really cover him. Or at least not everything that we know to be true about him. While he espouses perspectives that aren't shared by rightwing conservatives (about gays, ab0rtion), his actions tell a different story (filing briefs comparing gay marriage to incest & pedophilia, the executive order on the Stupak amendment, etc.).

Calling him a rightwing conservative also confuses rightwing conservatives, who can't see beyond the 'D' after someone's name, and think we're all liberals. I can't be responsible for their ig.no.rance and change the language to suit their wrong understanding of it.

It's for these reasons that I try to leave it as textbook as I can, to get us all on the same page linguistically at least.

I'm happy to oblige, however, if we can all get on the same page about his qualifications (as a rightwing conservative).

I suggest that you consider Democrats & Republicans as working on the same side, as tag relay teams (or like siblings competing for parental approval). 'Good cop/bad cop'. One side (Republicans) makes brazen frontal assaults on the People, & when the People have had enough, they put Democrats into power because of Democrats' populist rhetoric.

Once in power, Democrats consolidate Republicans' gains from previous years, & continue on with Republican policies but renamed, with new advertising campaigns. They throw the People a few bones, but once Democrats leave office, we learn that those bones really weren't what WeThePeople thought they were.

Whenever the People get wise to the shenanigans & all the different ways they've been tricked & start seeing Democrats as no different than Republicans, Democrats switch the strategy. They invent new reasons for failing to achieve the People's business -- This current one, because "Democrats are nicer, not as ruthless, not criminal" etc., is custom-tailored to Obama's 'bipartisan cooperation' demeanor. It's smirk-worthy when you realize they're trying to sell that they're inept, unable to achieve what they were put into office to do, & that's "a good thing".

Whichever of us is right (& I can back up my contentions with much evidence of Obama's not being any more ethical than BushCheney, beginning with his assertion that the president has the right to k!II American citizens with absolutely no due process, no oversight), how is his government's ineffectiveness working for you, for us? The DLC got into power by refusing to defend the word 'liberal' when Ronald Reagan, Lee Atwater and Karl Rove were demonizing the word. Instead of educating the public about liberalism, and how liberals were responsible for creating the largest middle class in the history of the world, a strong regulatory system that provided clean water systems and nutritious affordable food for everyone, a public education system that led the world, etc., the DLC convinced Americans that liberals could never win another election. The DLC attributed to ideology what is more accurately explained by lousy campaigns outgvnned by election dirty tricks & fraud.

When informed of the issues, most Americans agree with liberal policies. Neither they nor I would characterize themselves as far-anything or extreme, but mainstream. For example, nobody likes the idea of abortion, but most Americans do not want the government involved if they find themselves in the predicament of an unwanted pregnancy. And if you frame it as, "You like to k!ll babies?!?!?!?!", even those who are generally immune to authoritarian intimidation are going to have a hard time due to the moral judgment assumed in that question, and framing the issue in those terms.

The McLaughlin Group: It's the "Professional Left's" Fault

Imagine how far right Michelle Bernard is if she thinks Obama's a centrist.

Let's get some definitions on the table.

I am an old FDR liberal Democrat. I'm against privatization of government, and for regulated capitalism (like Naomi Klein, I'm for a mixed economy). I'm for social safety nets; those we have, those we've had, and others which we would have had had it not been for the Reagan "revolution", and which would have come in handy during tough times like this, and which might have prevented this meltdown from happening at all. Most of all, I'm for education. Free to all, all the way.

I am one of the 70% of liberals that comprise the Democratic Party.

The DLC (pro-corporate, anti-populist, the Republican wing of the Democratic Party), through no acclaimation of the People or Democratic voters, controls the Democratic Party. The DLC, DINOs, are ideologically the moderate Republicans of the 1950s & 1960s. It's a t00l of the corporations, just like Republicans.

Most Democratic voters have no idea what the DLC is or who is in it.

Obama isn't a centrist; he's a neoliberal ( http://en.wikipedia.org/wiki/Neoliberalism ). As the president, he heads the national Democratic Party, i.e., he's the de facto head of the DLC. He's a DINO. Obama & Democrats are NOT doing what Democratic voters put Obama & Democrats into power to achieve on their behalf, i.e., undo 30+ years of Republican programming.

Six Months Later, an Oil Disaster Spreads Across the Gulf

Obama is corrupt to the core. But it's not just his performance in this one area that informs my opinion.

It's his continuing just about all of the Bush-Cheney policies. It's his blocking of all investigations & prosecutions into Bush-Cheney, and the economic meltdown. It's his continuing failed wars in Iraq & Afghanistan. It's his appealing DADT when not appealing it would just end it. It's appealing DOMA, with an argument that gay marriage is equivalent to incest and pedophilia. It's substituting massive payoffs to Big Insurance & PhRma (and a rider ending women's access to ab0rtion) for real healthcare reform. It's his finance reform legislation that neither reforms nor fixes nor prevents economic meltdowns.

How does any Democratic voter defend Obama after he asserts he has the right to k!ll any American citizen with no due process or oversight? And 'preventive detention'? And his claims of 'state secrets' to deny courts even look at his a$$a$$ination program?

Six Months Later, an Oil Disaster Spreads Across the Gulf

I personally believe that in 22 short months with Obama at the helm, some increases in competence has arrived as the cronies have moved out.

======================================

You are a whackadoodle extraordinaire.

Obama lifted the drilling moratorium last week before the fallout from this report could prevent it.

BP is still in operation, drilling deeper and in more risky, dangerous sensitive waters than ever before. Not one criminal indictment after 11 people were k!lled in an explosion that may have triggered an extinction level event.

Obama & the DLC-controlled Democrats have learned the lessons of the Bush administration very well: If you want something badly enough, just keep at it until you wear opponents down.

Like all scandals in the US these days, once the spotlight is off, without strong advocates (and a president with integrity) everything goes back to business as usual. The spotlight doesn't even have to be turned off; it can be dimmed. Or other controversies can appear with their own spotlights, to share the stage.

BP is still in operation, no criminal indictments, and a drilling moratorium that was lifted with absolutely no pushback. Unregulated capitalism is a parasitic meme that is destroying us. With the Deepwater Horizon explosion, the greatest fear of this disaster is that enough phytoplankton were k!lled to alter the earth's atmosphere, pushing it from ecological disaster to extinction level event. And if it hasn't, transnational corporations will do a collective "WHEW!" and continue on, "business as usual", shrugging off regulations, until they actually succeed in k!lling all living things on the planet.

The DLC-controlled DemocraticParty, with neoliberal BarackObama now at the helm no longer practices any of the common sensibilities of the once liberal DemocraticParty that created the largest middle class in the history of the world (& without a middle class, you can't have a democracy), which earned the world's respect & admiration (& kept Americans safe from acts of t3rror).

Obama ran on a pledge that he'd end corporations getting tax breaks for outsourcing. Just another of his broken promises, along with dropping his pledge to renegotiate NAFTA (http://www.democracynow.org/2009/8/11/obama_reverses_campaign_pledge_to_renegotiate ) & then by pushing to pass NAFTA-style trade agreements with SouthKorea, Panama & Colombia ( http://www.nytimes.com/glogin?URI=http://www.nytimes.com/2010/07/08/us/politics/08exports.html&OQ=_rQ3D1&OP=4808f024Q2FitMciW_OwB__hgig-!-i-,i-Q27i7wi(_PQ7ChQ7COwi-Q27MD(_BhwQ254hQ20P ).

Expect more NAFTA-type trade agreements after Nov. 2nd, & what we should be talking about instead of witchcraft & teabaggers (a handful of candidates, few if any will get into office, and who will all be under the control of establishment Republicans like MitchMcConnell & JohnBoehner).

CongressmanTimBishop is preparing to introduce bipartisan legislation to amend the Fiscal Year 2011 StateDepartment & ForeignOperationsAppropriationsBill to prohibit USAID from funding outsourcing training programs.

As MichaelGendron of CommunicationsWorkersOfAmerica (which has hundreds of members out of work due to outsourcing & the economic downturn) said: "Any investment in outsourcing is a bet against American workers."

There is no misinformation in what I posted.

How does USAID's "function" mitigate the fact that US taxpayers' money is going to train foreign workers to take jobs outsourced from the US? Our government is using the foreign aid budget to help transnational corporations outsource IT work.

BUT we're NOT (flush, fully employed), and we ARE (in a Depression).

In other times, when the US is flush, when Americans are fully employed, when we're not in a DEPRESSION, not a bad idea. But it begs the question: Why aren't transnational corporations using their obscene profits for such an enterprise?

Your defending such a program in these times tells me you're a knee-j3rk 0bamab0t/political operative paid to spread disinformation, a closet Republican, living a phat life being financed by cheap overseas labor (stock dividends). Or, you just have your head up your arse.

14 Days to Go and the President Is Killing Democrats

You can't just vote every 2 or 4 years, especially if you're voting for Democrats. You have to join your local Democratic Party, work within it and get the DLC out.

I'm also saying that you are not limited to voting for just Democrats and Republicans. There are other alternatives besides sitting out the election or voting for Republicans. There are other candidates running as independents, from Green to Libertarian, in just about every race.

Anyone who tells you to be quiet, not criticize Obama and Democrats, that you must vote for Democrats because they're "the lesser of 2 ev!ls", tell them to STFU because they're trying to deny your holding your elected representatives' feet to the fire and live up to their campaign promises. They're also DLC operatives (or have been bra!nwashed by DLC operatives).

14 Days to Go and the President Is Killing Democrats

I'm saying many things.

I would never recommend that citizens stay home and not vote. If you're not at the table, you're on the menu.

I think voting should be a requirement of citizenship, I think 'election day' should be 'election weekend', a holiday, paid time off from work. I think all elections should be publicly financed and that hard copy receipts shouldn't even need to be debated.

I'm also saying that if you are voting for Democrats because you identify with the Democratic Party, its ideology and platform, you aren't getting candidates who are committed to Democratic ideology and the party's platform. These days you're getting moderate Republicans posing as Democrats. The Democratic Party is controlled by the DLC (the Republican wing of the party, pro-corporate, anti-populist), and that's who and what the DLC is recruiting for office.
