For had you done that, you would have seen your argument was addressed and decimated:

Congress can continue to work on ending it through legislation, while individuals and groups go about ending it through the courts (the Log Cabin Republicans lawsuit has taken 6 years to get to last month's decision in the federal court; it's nowhere near over).   There's no reason all can't happen simultaneously, and should.
